Please note that that we will protect your privacy. Spot will not sell or share personally identifiable information (PII) about you or with any person or organization EXCEPT the following
(ii) as described in the relevant portion of the Spot Network App (the “App”) and Website (the “Website”),
(iii) in connection with providing various Services provided by us to you, (the “Services”),
(iv) to the extent you make any use of Spot Network’s mobile app or website commonly referred to as “Spot” or any other app or Services provided by us to you via our apps or websites,
(v) as may be required by law or court order or as otherwise set forth herein.
Regardless of where our servers are located, your personal data may be processed by us in the United States, where data protection and privacy regulations may or may not be to the same level of protection as in other parts of the world.
BY VISITING THE WEBSITE AND USING THE SPOT NETWORK APPS, YOU UNEQUIVOCALLY AND UNAMBIGUOUSLY CONSENT TO THE COLLECTION AND PROCESSING IN THE UNITED STATES OF ANY INFORMATION COLLECTED OR OBTAINED BY US THROUGH VOLUNTARY SUBMISSIONS, AND THAT U.S. LAW GOVERNS ANY SUCH COLLECTION AND PROCESSING.
We collect two types of information about persons who use the Spot Network: voluntarily provided personal information and automatically collected information by our apps and servers.
PERSONAL INFORMATION COLLECTED
We collect certain Personal Information about you, which may be supplied when you sign-up or install the apps, when you submit or post Media, when you create or update your account, when you use the apps or website, when you request services or complete a purchase or transaction, or otherwise when you submit information explicitly or implicitly by using the App or website. The information that may be collected includes:
• Phone number;
• Device identifiers;
• Location data (latitude / longitude);
We take precautions to protect your information. When you submit sensitive information via the website and/or app, your information is protected both online and offline. Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers and servers in which we store personally identifiable information are kept in a secure environment. Although the Service may ask for a payment card at times, we collect this information through a third-party payment processor, and we do not take possession of your card information.
Non-Personal Information is non-personally identifiable or anonymous information about you, including but not limited to age, gender, links and materials posted, enrollment history, the type of device you used and its operating system, the pages accessed most frequently, how pages are used, applications downloaded, search terms entered, and similar non-personal data. Automatically Tracking Internet Protocol (IP) addresses is one method of automatically collecting information about your activities online and information submitted or posted by you. An IP address is a number that is automatically assigned to your device whenever you surf the Internet. Further, the Service may utilize web beacons, pixel tags, cookies, embedded links, and other commonly used information-gathering tools. Our Service may also collect device ID’s. Although it may be possible to turn off the collection of cookies or other information collection tools through your device, that may interfere with your use of the Service. We may request permission and access your photo gallery, camera roll or other device storage area holding your images, in order for you to upload and share Media (photos or videos or even live broadcasts) through our apps and website.
USE OF INFORMATION – INTERNAL USE OF INFORMATION
We accept and gather information in an effort to provide the Service to you. We may also use this information to help us develop and improve our Service, fulfill your requests, send materials to you, inform you about our offers, and for any other purposes permitted by law to help us make money so we can provide great content to you through our apps and websites.
SHARING INFORMATION COLLECTED WITH THIRD PARTIES, CONSULTANTS, AND AFFILIATES
We may share personal information with our business associates, consultants, service providers, advisors and affiliates in order for them to provide services to us, to you, and to enable us to provide the Service. For example, our host and Internet Service Provider (“ISP”) may have access to this information. We may disclose your profile, image and uploaded Media as featured users on our service, for marketing purposes. We may also share non-personal information for marketing purposes. We may incorporate your personal and non-personal information into an aggregate databases, using industry standard methodology to anonymize the data, and we may use such anonymous aggregate databases for our general business purposes, including sharing such databases and analysis derived therefrom with others. We may share your personal and non-personal information with Publishers that purchase licenses to your Media.
We are particularly sensitive to the storage and use of location data that we collect about individuals and Users on the Service, whether as a Buyer or Seller. Your location may be shared when you share it through the Service, when Buyer’s respond to offerings of Media by You as a Seller on the Service and when you submit and post Media on the Service for license or sale. In addition, any Media you submit or post to Spot Nework may include location information in its metadata, and by sharing such materials, you may be disclosing your present or prior location.
Furthermore, in order to provide the greatest value to viewers on the Spot Network App and website, it is best for us to have your mobile devices location disclosed, which is done both automatically through Location Services through the phone. Whenever you open and use/interact with our apps on your mobile device or go to our website, we will try to use the location information from your mobile device or browser (e.g., latitude and longitude) to provide location to our sponsors and partners. This information is MAY be shared with others, including ad-buyers, sponsors and partners of Spot Network. Also, Spot Network will attempt to use your mobile device’s ‘background location” to send you notifications of events or activities near your location. If you have ‘background location’ turned on, the Spot Network app may, from time to time, tell us about your device’s location even if you are not directly interacting with the application.
Sharing Location with the Spot Network app – If you submit or post Media or otherwise interact, take a photo, capture a video or the like with a place, Buyers may infer that you have been to that location. Some Media may be time stamped and other users could use that information to infer when you were at a place even though some Media can be posted when you are not at the location anymore.
Notwithstanding the foregoing, we may disclose personal and non-personal information to the extent we believe it necessary to comply with the law, such as in response to a subpoena or court order, to defend a legal claim or otherwise as permitted by applicable law. We may disclose any information in our possession in the event that we believe it necessary or appropriate to prevent criminal activity, personal injury, property damage or bodily harm. Additionally, we may transfer your personal and non-personal to successor in interest, which may include but may not be limited to a third-party in the event of an acquisition, sale, merger or bankruptcy.
We employ procedural and technical safeguards to secure your personal information against loss, theft, alteration, and unauthorized access, use and disclosure. We also employ security procedures to protect your information from unauthorized access by users inside and outside the company. Regardless of the precautions we take, no transmission of data over the Internet is guaranteed to be completely secure. It may be possible for third parties not under our control to intercept or access transmissions or private communications unlawfully. While we strive to protect personal information, we cannot ensure or warrant the security of any information you transmit to us.
E-MAIL AND ELECTRONIC NEWSLETTERS
We may offer electronic newsletters and e-mails concerning promotions, new products and services, or other marketing materials as a service to our users. You may receive newsletters and e-mails concerning promotions and marketing of ours, after you register through with the Service. If, after you have received a message, you no longer wish to receive such materials, you may opt-out by following the unsubscribe instructions included in each electronic newsletter and e-mail.
ACCESS AND CONTROL
Some of the information collected about you will be retrievable and changeable through your username login. To do so, follow instructions on the Service.
The Service may contain tools that enable you to share personal information, including sensitive information, with others, through social media and in other ways. Should you choose to use such tools, please exercise caution when sharing sensitive information. The Service will not share this information in this manner without you directing it to do so.
PROTECTION OF SPOT NETWORK AND OTHERS
We may release Personal Information when we believe in good faith that release is necessary to protect the safety of another, or to comply with the law, including laws outside your country of residence; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Spot Network, our app, our users, employees, consultants, or others. This includes exchanging information with other companies and organizations (including outside of your country of residence) for fraud protection and credit risk reduction.
DO NOT TRACK
At this time, the Service does not specifically respond to do-not-track signals. We do not knowingly permit users to register for our Service if they are under 13 years old, and therefore do not request personally identifiable information from anyone under the age of 13. If we become aware that a customer is under the age of 13 and has registered without prior verifiable parental consent, we will remove his or her personally identifiable registration information from our files. If you are the parent or guardian of a person under the age of 13 who has provided personally identifiable information to us without your approval, please inform us by contacting us at the e-mail address below and we will remove such information from our database.
CALIFORNIA PRIVACY RIGHTS
California law allows California residents to request information regarding our disclosures in the prior calendar year, if any, of their personally identifiable information to third parties. To make such a request, please contact us at firstname.lastname@example.org with “Request for Privacy Information” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, email, and username, if any. We will attempt to provide you with the requested information within thirty (30) days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that this law does not cover all information sharing. Our disclosure only includes information covered by the law.
If Spot Network or substantially all of its assets are acquired or in the unlikely event that we go out of business or enter bankruptcy, user information would be one of the assets that could be transferred or acquired by a third party.
